Please read these Terms and Conditions carefully before placing any order or using the services of MJW Surgical. By contacting us or placing an order you agree to be bound by these terms.
These Terms and Conditions govern the relationship between MJW Surgical ("the Company", "we", "us", "our"), a surgical, dental and professional beauty instrument manufacturer UK registered company and operating from Sialkot, Punjab, Pakistan, and any person, business, distributor, hospital, dental practice, university or organisation ("the Buyer", "you", "your") that contacts us, requests a quotation, places an order or purchases products from us.
By submitting a quote request form, sending an email enquiry, placing an order by any communication method, or making payment for any products or services provided by MJW Surgical, you confirm that you have read, understood and agree to be bound by these Terms and Conditions in full.
MJW Surgical manufactures and exports surgical instruments, dental instruments, suture practice pads and kits, and professional beauty and grooming equipment. All products are manufactured at our facility located at Bara Pather Christian Town, Sialkot, 51310, Punjab, Pakistan.
Product information provided on our website, in catalogues and in quotations is provided in good faith and is believed to be accurate at the time of publication. We reserve the right to update product specifications, pricing and availability without prior notice. Product images shown on our website and in catalogues are representative of the product range and individual items may vary slightly in appearance.
- All surgical and dental instruments are manufactured to the specifications described in the relevant catalogue
- CE marking applies to applicable products for import and use in the United Kingdom and European Union member states
- ISO 9001, ISO 13485 and GMP certification applies to our manufacturing facility and production processes
- Product certifications and compliance documentation are provided upon request and with every shipment
- Custom product designing and packaging is available subject to minimum order quantities and separate agreement
All orders placed with MJW Surgical are subject to our written acceptance. An order is not confirmed until MJW Surgical has issued a written order confirmation or proforma invoice to the Buyer. Verbal agreements, informal messages and enquiries do not constitute an accepted order.
Orders may be placed by email, WhatsApp, or through the quotation and enquiry forms on our website. All order details including product specifications, quantities, packaging requirements, destination country and delivery terms must be confirmed in writing before production commences.
- MJW Surgical reserves the right to decline any order without obligation to provide a reason
- Changes to confirmed orders must be made in writing and are subject to our agreement and any additional charges arising
- Cancellation of confirmed orders may result in cancellation charges depending on the stage of production
- We do not offer product samples prior to bulk orders
- Minimum order quantities apply to certain product lines — these are confirmed at quotation stage
All prices quoted by MJW Surgical are in Great British Pound (GBP) unless otherwise stated in writing. Prices provided in quotations are valid for the period stated in the quotation. If no validity period is stated, prices are valid for 30 days from the date of the quotation.
In some countries, quoted prices do not include international freight, insurance, customs duties, import taxes, VAT, GST or any other taxes or charges applicable in the destination country. These costs are the sole responsibility of the Buyer unless otherwise explicitly agreed in writing.
MJW Surgical accepts payment by the following methods only:
- International Bank Transfer (TT / Wire Transfer / Stripe / Debit Card / Visa Card) — payment in full or agreed deposit before production with balance before shipment
- PayPal — subject to applicable PayPal transaction fees which are the responsibility of the Buyer
Standard payment terms for new customers are 50% advance deposit upon order confirmation with the remaining 50% payable before shipment. Payment terms for established customers may be discussed and agreed separately in writing. Production will not commence until the agreed advance payment has been received and cleared.
All bank charges, transfer fees and currency conversion costs associated with international payments are the sole responsibility of the Buyer. Payments must be made in the currency specified in the proforma invoice.
MJW Surgical exports products worldwide. Delivery terms are agreed at the time of order confirmation. Risk of loss or damage passes to the Buyer in accordance with the agreed delivery terms.
Lead times and delivery estimates provided are approximate and are not guaranteed. MJW Surgical is not liable for delays caused by factors outside our control including but not limited to customs processing, shipping carrier delays, port congestion, force majeure events, or regulatory issues in the destination country.
- MJW Surgical will provide all required export documentation including commercial invoice, packing list, certificate of origin and relevant compliance certificates
- Shipping arrangements can be made by MJW Surgical on behalf of the Buyer at their cost and risk.
MJW Surgical maintains ISO 9001 and ISO 13485 certified quality management systems and GMP certified manufacturing practices. All products are inspected before despatch in accordance with our quality management procedures.
The Buyer is responsible for inspecting goods upon receipt. Any claims for shortage, damage or non-conformity must be submitted to MJW Surgical in writing within 14 days of receipt of the goods, supported by photographic evidence and a detailed description of the issue. Claims submitted after this period may not be accepted.
- Claims relating to damage in transit must be reported to the MJW Surgical within 7 days of delivery
- We reserve the right to inspect returned goods before agreeing any replacement or credit
- Minor variations in finish or appearance that do not affect the functional performance of the instrument do not constitute grounds for rejection or return
- Custom-manufactured or specially branded items are non-returnable except in cases of manufacturing defect
All content published on the MJW Surgical website including text, images, product catalogues, photography, design elements and brand materials is the intellectual property of MJW Surgical and is protected under applicable copyright and intellectual property law. Unauthorised reproduction, distribution or use of any content from the MJW Surgical website or catalogues is strictly prohibited without our prior written consent.
The MJW Surgical name, logo and brand marks are the property of MJW Surgical. Buyers who purchase products for resale may describe the products as manufactured by MJW Surgical Sialkot, Pakistan only where this has been agreed in writing. Custom-branded product orders are produced for the exclusive use of the commissioning Buyer as agreed in the relevant order.
MJW Surgical provides CE marked products for the UK and EU markets and maintains ISO 9001, ISO 13485 and GMP certified manufacturing. However, the Buyer is solely responsible for ensuring that products purchased from MJW Surgical comply with all applicable regulations, standards and requirements in their country or region of import and use.
- Buyers importing into the United Kingdom, European Union or United States are responsible for compliance with all applicable medical device import regulations in their jurisdiction
- MJW Surgical provides CE certificates, ISO certificates and relevant documentation to support the Buyer's compliance obligations but does not provide regulatory or legal advice
- Beauty and grooming instruments must comply with applicable product safety regulations in the destination country — the Buyer is responsible for verifying compliance
- Suture practice pads and training kits are educational training products and are not medical devices intended for use on human patients
MJW Surgical shall not be liable for any failure or delay in performing our obligations under these Terms and Conditions where such failure or delay results from circumstances beyond our reasonable control. Force majeure events include but are not limited to natural disasters, war, terrorism, government actions, pandemics, strikes, power failures, raw material shortages and acts of God.
In the event of a force majeure situation, MJW Surgical will notify the Buyer as soon as reasonably practicable and will use reasonable efforts to minimise the impact on order fulfilment. If a force majeure situation continues for more than 60 days either party may terminate the affected order by written notice without further liability.
In the event of any dispute arising from or related to an order or these Terms and Conditions, the parties agree to attempt to resolve the dispute through direct negotiation in good faith before pursuing any formal legal proceedings. Either party may initiate the negotiation process by providing written notice of the dispute to the other party.
If the dispute cannot be resolved through negotiation within 30 days of the written notice, the parties may refer the dispute to arbitration or pursue resolution through the courts of competent jurisdiction in Pakistan. Nothing in this clause prevents either party from seeking urgent injunctive or other emergency relief from a court of competent jurisdiction.
MJW Surgical reserves the right to update or modify these Terms and Conditions at any time. The updated Terms and Conditions will be published on our website with a revised effective date. Continued use of our website or placement of orders after any such changes constitutes your acceptance of the updated terms.
